3 to die by hanging in Yola

The Yola Division of the Federal Court of Appeal has affirmed the judgment of the state High Court sentencing three men to death by hanging for armed robbery and culpable homicide.

The Court of Appeal held that the state High Court acted in the interest of justice by sentencing the convicts to death by hanging, and upholds the penalty.

The convicts, Rabiu Alhaji Wada, 25, Luka Umaru,35, and Hamisu Sani, 22, all from Adamawa State, were handed down the death sentence after pleading guilty to the three-count charge of conspiracy, armed robbery and culpable homicide.

The three were convicted for conspiracy and armed robbery while armed with offensive weapons contrary to section 6(b) and punishable under section 1(2) (a) of the Robbery and Firearms (Special provisions) Act Cap R11 Laws of Nigeria.

The convicts had earlier been arraigned before the state High Court presided by Hon. Justice Abdul-Aziz Waziri on the 23th February, 2017.

The High Court had while delivering its judgment in suit number/ADYS/17c/2017/ on the 10th April, 2018, sentenced them to death by hanging for the offences.

The court had specified that the convicts were to be hanged by the neck until a medical doctor certified them dead.

The trio had chosen to appeal the verdict of the lower court, and filed their appeal on 6th July, 2018 on the grounds that the lower court erred in law when it convicted them solely on a confessional statement which they retracted.

Delivering its judgment on the matter, the Court of Appeal, presided by Hon. Justice Chidi Nwaoma Uwa, dismissed the application and affirmed the judgment of the state High Court.

INEC gives update on Sokoto rerun election

The Independent National Electoral Commission (INEC) has pledged to collaborate with Economic and Financial Crimes Commission (EFCC) and other agencies to ensure transparency in the conduct of rerun elections in Sokoto State.

The state Resident Electoral Commissioner (REC), Mr Abubakar Sadiq, stated this on Thursday at a stakeholders meeting preparatory to the election for four political seats scheduled on Jan. 25, 2020.

Sadiq said training of workers for the election had begun to ensure that they carry out their duties diligently.

He urged politicians to play the game by the rules, stressing that INEC would be transparent in its dealings throughout, NAN reports.

Sadiq said that INEC has also sought the collaboration of security agencies and community leaders to effectively manage the elections, stressing that it would not condone any electoral fraud.

The INEC Head of Operation in Sokoto, Malam Lawal Ladan, said the rerun seats are for Sokoto North/Sokoto South Federal Constituency, Isa/Sabon Birni Federal Constituency, Binji and Sokoto North State Assembly positions.

Ladan adduced said to ensure hitch-free elections, transportation of materials, personnel and proper functioning of equipment as well as security management were paramount.

Malam Muktar Ibrahim, the Head of Election and Party Monitoring, INEC Sokoto, said candidates from 39 political parties would participate in the rerun elections.

Ibrahim urged party officials to submit agent lists along with their passport photographs on time and not to engage in bad deals.

He said efforts would be made to ensure monitoring and reporting of violent situations for appropriate actions.

Sokoto State Commissioner of Police, Mr Ibrahim Kaoje, assured maximum security before, during and after the elections.

Kaoje said no bandits operate across the state, therefore, smooth election is expected even in volatile areas.

He said the police had identified some volatile areas especially in Sokoto and would deploy policemen to such areas and to each polling unit, besides other security officials to be stationed at least 500 meters away from the polling units.

”NYSC members and other workers are our children, so we need to protect them and maintain the peace in general” Koaje said.

EFCC representative, Mr Uchenna Eze, said the agency would mobilize officers to monitor vote buying as it’s a criminal offence.

We didn’t defect to APC with Gboyega Isiaka – Ogun ADC Chieftain cries out

Reactions have been trailing the defection of the Governorship Candidate of the African Democratic Congress (ADC), Gboyega Nasir Isiaka, into the ruling All Progressives Congress (APC) in the state.

DAILY POST recalls that Isiaka, fondly addressed as GNI, was on Tuesday received into the APC fold by Gov Dapo Abiodun of Ogun.

But some ADC leaders said they have not defected with the three-time governorship candidate into the Dapo Abiodun faction of the APC.

DAILY POST observed that Isiaka’s defection has split the ADC across the state, even in Isiaka’s Imeko-Afon Local Government, as some leaders and members of the party refused to defect with the gubernatorial candidate.

It was earlier reported that some diehard supporters of the Investment Banker have deserted him over his decision to move to the APC.

While some are said to have defected into the Peoples Democratic Party (PDP), others who remain in the ADC are yet to decide on their next political move, DAILY POST learnt.

Speaking, Isiaka’s ADC Ward Chairman in Imeko, Amuda Olaleye, informed that he is still in the ADC.

Olaleye, who spoke in Yoruba (Imeko dialect) said on Thursday that, “I didn’t defect to anywhere, As I speak I am still in the ADC. Isiaka told me he will be defecting and I told him bluntly that I won’t be defecting with him.

“Even if I want to defect to APC, I will seek another better person’s link and not through him. I have followed him three times and I have stopped. If one will walk with a person, he should work with a better person.

“Not everybody here (in Imeko) defected with Isiaka. People are now very wise and as a result, I have a lot of people who did not defect with him, we are now very wise.”

An anonymous source told our correspondent that the only House of Representatives member, Hon. Olaifa Aremu and the three House of Assembly members delivered by the party had refused to defect with Isiaka.

It was also gathered that the ADC Chairman in Isiaka’s Imeko Afon Local Government, Hon. Kayode Elegbede did not defect as well.

However, while some APC members were happy with Isiaka’s defection into the party, others have been expressing misgivings.

There are some who have been alleging that GNI and his supporters are coming to shortchange them or strip them of political appointments that should come their way, especially at the federal level.

The immediate past Councilor at ward 11 in Abeokuta South, Hon. Ali Ekundayo, accused Isiaka of jumping from one party to another; saying he was defecting out of his “personal selfishness” with the sole aim of securing a federal appointment.

“He has defected out of his personal selfishness with the main focus of securing federal appointments meant for original party faithfuls.

“You can’t expect me to be happy, after being in this party for 10 to 15 years and some people will just come and cart away all that we have worked for. Well, let us wait and see if God will allow them.”

Also, Aina Jaji, a longtime member of the APC in Ogun State said, “I am not perturbed if this is happening now. It only tells us the kind of politics we play in this part of the world. It all bothers on morality and integrity. After contesting three times in three different parties, he is now coming back to APC? What an aberration!”

But Isiaka, before his official defection, said he and his Believe Movement members did not form an alignment with Gov Dapo Abiodun of the state to get political appointments.

But Gov Abiodun, while receiving Isiaka on Thursday, assured him and his followers of political appointments and other entitlements as APC members.

Abiodun disclosed that some appointments have been kept for them, even before their arrival into the party.

Kanu reveals plans to support Amotekun with 1million IPOB men

Nnamdi Kanu, leader of the Indigenous People of Biafra, IPOB, on Thursday, commended Southwest governors for setting up Amotekun security outfit.

Kanu assured that members IPOB were ready to support Operation Amotekun with all their might.

In a statement by IPOB’s spokesperson, Emma Powerful, Kanu said he was ready to support the Southwest security outfit with one million men.

According to Kanu: “The final and definitive stance of the Biafran people is that IPOB will support Operation Amotekun with all our might.

The governors explained that Amotekun was established to curb the issues of insecurity in the Southwest.

Rapists in Adamawa to get special treatment- State Attorney General

The Adamawa State Government is to designate a court for the specific purpose of adjudicating over rape cases.

The government made the pronouncement Thursday against prevailing high number of rape incidents, most of them poorly prosecuted in the general courts.

The state Attorney General and Commissioner of Justice, Barr Afraimu Jingi, who spoke on the matter to newsmen in his office at the state Secretariat in Yola, said the court to be designated would have personnel whose dedication would be to handle rape cases.

Fielding questions from newsmen who reminded him that the previous administration had towards the end of its term made commitments to establishing a Special Court for rape trials, Afraimu Jingi said the approach would not be exactly the same.

“We are not establishing a special court but we are working on designating an existing court to try rape cases and give speedy justice,” he said.

Cases of rape have been rife in Adamawa State in the last couple of months and years, just as kidnapping cases have been also particularly troubling.

The Attorney General said relevant officials of his ministry and the government were working on ways to effectively prosecute suspected rapists and kidnappers alike to check the vices.

Supreme Court Judgement: ‘Buba Galadima is suffering from political dysfunction’ – Kano State Gov. Ganduje

Governor Abdullah Umar Ganduje of Kano State has accused the leader of the defunct Congress for Progressives (CPC) Alhaji Buba Galadima of suffering from political malfunction.

Ganduje also described Buba Galadima’s claims on Kano state governorship election as baseless and lacking in required merit as well as a claim coming from a dysfunctional politician.

Galadima, had yesterday said the Supreme Court verdict that removed Emeka Ihedioha as governor of Imo state should not exonerate Governor Abdullah Umar Ganduje of Kano state due to what he considered similar incidence .

Galadima told journalists in Abuja, that the technicalities considered and applied by the apex court which affirmed Hope Uzodinma as governor of Imo state on Tuesday, tied to the cancellation of votes he allegedly belong to Abba Kabiru Yusuf of (PDP) Kano.

But responding, Governor Ganduje through his elections cases legal team leader, Barrister Mohammad Abdullahi Lawan contended that the view of Galadima was absolutely no correlation between the facts and circumstances of the Emeka Ihedioha case and that of governor Ganduje, insisting that points raised by the PDP stalwart was rather unbridled ignorance of the law.

In a release made available to journalists, Barrister Lawan explained that “ In the former (Ihedioha case), whilst there was glaring evidence of the cancellation of results by officials other than the presiding officers, in the later case (Governor Ganduje) there was no evidence of such cancellation by officials order than the presiding officers. Instead, there was proven evidence in the Governor Ganduje case, that the cancellation of some of the 207 polling units were carried out by the respective INEC Polling Unit Presiding Officers as was clearly depicted in the numerous Form ECG 40s tendered and admitted in evidence without any objections by the Petitioners.

“Again, in the Ganduje case, there was the inability of the INEC to collate the results of 62 polling units in Gama ward comprising of over 48,000 registered voters in an election with a lead margin of only 26,000 votes! What is worse is that the disruption of the collation of the said results was caused by the PDP agent, one Dr Yakasai who testified as PW30. He admitted that whilst the said results were being collated, a commotion arose and he carted away the original Results of INEC and hid himself in a room for over one hour with a Biro with him! He kept the sensitive INEC documents in his custody for another hour before allegedly taking the said documents to the Kano Commissioner of Police instead of INEC.

“In the end, only twelve of those results were tendered in court by the Police. How on earth was the INEC supposed to collate the said results? Could the INEC have declared in an inconclusive election and thus disenfranchise over 48,000 voters in an election where the lead margin is only 26,000 votes. Finally the so called expert witness called by PDP admitted on oath that after his study of all the results, he agreed with the INEC cancellation of the results of 77 polling units on the basis of over voting. This in law is an admission against interest which the various courts are obliged by law to accept and which the two lower courts accepted”. Barrister Lawan maintained.

The coordinator of Ganduje legal team, explained that Galadima argument was fallacious and must be discountenanced by the general public.

Lawan who restated Governor Ganduje’s conviction on the credibility and hope in the judiciary however debunked any negative tendencies suggesting possible illusion and pressure against the Supreme Court Judgment on Kano gubernatorial election slated for 20th, January, 2020

Rocky Johnson passed away on Wednesday, January 15, 2020, in Tampa Bay at the age of 75.

His cause of death is currently unknown, TMZ reports.

Rocky “Soulman” Johnson started out in the National Wrestling Alliance in the 1960s but got widespread notoriety when he joined the WWE in the 80s.

He and Tony Atlas became the league’s first African-American tag team champions as The Soul Patrol.

NCC unveils strategy for curbing call masking, refiling under Danbatta

The Nigerian Communication Commission, NCC, says call masking and refiling has been curbed under the leadership of Professor Umar Danbatta.

According to NCC, in the wake of 2017, the menace of call masking/call refiling and SIM boxing reared their ugly heads but the Commission took drastic actions towards addressing the issue.

The NCC explains that call masking is when inbound international calls terminating in Nigeria as a local number.

This raises serious security concerns, competition issues among licensees and portends negative economic implications in terms of losses of appropriate taxes accrued to the government through inbound international calls. In fact, it is estimated that globally, call masking is causing the economy $60 billion annually.

However, the Commission said in a statement signed and sent to DAILY POST by Kunle Azeez, Head of NCC Public Affair (Online Media and Special Publications) that NCC “took a number of regulatory actions towards curbing the menace of call masking: These include ensuring strict compliance monitoring and enforcement by the Commission; imposition of appropriate sanctions by the Commission on licensees involved in call refiling and masking activities; and suspension of numbering plans of some perpetrators and withdrawal of all their inactive numbering plans”.

“Other measures are taken in this regard include the continuous sensitization of consumers and other industry stakeholders on the dangers of call masking, which is still ongoing; the development and institution of new reporting requirements on interconnecting licensees that make it easy and seamless to quickly identify perpetrators of call masking and the Proof of Concept (PoC) commenced in July 2018 with the deployment of technology solutions to monitor, report, apprehend and block SIMs being used for SIM boxing activities and prevent SIM lines from being used for call masking activities.

“The above smart interventions generated profound results for the industry. First, by the end of 2018, call masking (otherwise called call line identity (CLI) spoofing) had dropped to more than 40 percent compared to how prevalent it as of January 2018. Also, SIM boxing traffic was down by about 25 percent as of September, 2 018.

“Today, following further enforcement by the Commission for telcos to deploy special technology solution across their networks, cases of call-masking or call refiling, consumer complaints around call-masking have practically come to a halt.”

The NCC also said that under the leadership of Danbatta as its Executive Vice Chairman, it boosted the quality of service and investors’ confidence.

It said that in keeping with its continuous commitment towards ensuring that telecoms operators deliver consistently improved QoS to their over 179 million subscribers, it had in the last four years embarked on a series of initiatives that have relatively helped in boosting the quality of service delivery across mobile networks.

The statement added that “Through continuous monitoring of operators’ compliance with the Key Performance Indicator (KPS) on Quality of service (QOS) on a state-by-state level, as against measuring operators’ compliance on a national average basis, the regulator helped to boost QoS delivery in this regard. Today, complaints associated with call drops and related have reduced remarkably.”

The Commission said it also stepped up stakeholder engagement and collaboration both within the private and public sectors of the economy to address salient and trendy issues affecting the industry, as it continues to make remarkable inroads in this direction.

The statement added that the Commission’s timely interventions in Ogun, Kano and Kogi state among others, resolved cases of the indiscriminate shutdown of telecoms sites by state agencies over disputed taxes and levies are worthy of highlighting.

It said “In Kogi State, for instance, more than 70 base stations were sealed by the Kogi Inland Revenue Service (KIRS) in 2018. Going by the nature of telecommunications service, which relies on 24/7 availability, each time a base station is shut down or sealed by a state agency, it automatically affects several services depending on such telecoms platform for proper functioning, exerting adverse effects on the economy of the affected area as a whole.

“It is instructive to note that a similar intervention by the Commission, in collaboration with the CBN helped to rescue Etisalat Nigeria (now 9mobile) from the brink of collapse following a financial crisis involving a $1.2 billion syndicated loans obtained by the telco from a consortium of 13 banks. The landmark intervention gave the hitherto troubled telco a new lease of life as it has now regained its growth momentum.”

Assuring investors of the regulator’s determination with regard to the safety of their investment in Nigeria, Danbatta said at a forum that, “The NCC is working to address challenges facing the industry and most importantly, in the area of achieving a more friendly and enabling operating environment for faster telecoms infrastructure deployment.

“Only through this can we have improved Quality of Service (QoS) that will automatically translate to an improved Quality of Experience (QoE) for the over 172 million telecoms consumers in the country as well as sustain the confidence of investors in the telecom industry.”

He added further that, “the industry, having achieved over $70 billion investment, requires even greater infrastructure investment to achieve better digital transformation for our nation.

“To this end, all hands must be on deck. We need to understand the critical role that access to telecoms services play in all facets of our economy and we must work together to support the industry’s sustainability through improved quality of service and quality of experience for the consumers.”

The NCC said it engages consulting firms to carry out studies that aid its regulatory decision towards engendering healthy competition in the industry.

It said “For instance, the Commission engaged KPMG Professional Services to conduct a study on the Assessment of the Level of Competition in the Nigerian Telecommunications Industry. Today, competition has led to optimal performance from the different service providers because there is always that pressure from the insatiable consumers. “
