Lagos Court arraigned woman over breach of peace, gets N400,000 bail

Oluwakemi Akinpelu, a 32-year bussinesswoman, arraigned in an Ikeja Chief Magistrates’ Court on Monday for alleged breach of peace, was on Monday awarded a N400,000 bail.

Akinpelu, whose residential address was not provided, is facing charges of breach of peace and unlawful interference with property.

She, however, pleaded not guilty to the charges.

Earlier, the Prosecutor, SP Akeem Raji, alleged the defendant conducted herself in a manner likely to cause a breach of peace by illegally constructing a shop on the property of the complainant, one Mr Adebayo Asimiyu.

Raji told the court that the defendant committed the offences sometimes in August, 2019, at No. 1 Toaridi St., off Bode Thomas, Surulere, Lagos.

He submitted that the defendant unlawfully disconnected, removed and tampered with the building by erecting an illegal structure to deface it without the complainant’s consent.

“The defendant allegedly constructed a shop which was different from the one she rented and paid for.

“She did this without the approval of the complainant, and when she was told to remove it, she refused,” the prosecutor said.

Chief Magistrate Yetunde Aje-Afunwa, admitted the defendant to N400,000 bail with two sureties in like sum.

Aje-Afunwa ordered that the sureties must be gainfully employed and have evidence of three years’ tax payment to the Lagos State Government.

The offences violate sections 168 and 340 of the Criminal Law of Lagos State 2015.

Unlawful meddling with property is punishable with three years’ imprisonment, while breach of peace attracts six months jail term for offenders.

The magistrate adjourned the case until Sept. 21 for mention.
