Election Tribunal: Atiku Withdraws Court Application Against INEC

On March 3, Atiku Abubakar was granted permission to inspect sensitive election materials used by INEC in the February 25 presidential election.

Atiku Has Withdrawn An Application For Access To Electoral Materials

The presidential candidate of the Peoples Democratic Party (PDP), Atiku Abubakar, has withdrawn the application from the Appeal Court.

In the application, Mr Atiku had asked the court to compel the Independent National Electoral Commission (INEC) to follow an earlier order.

Mr Atiku lost the presidential election to the All Progressives Congress (APC) presidential flagbearer, Bola Tinubu. 

However, the PDP candidate has refused to accept defeat and has chosen to seek redress in court.

A Court of Appeal on March 3, permitted Mr Atiku to inspect sensitive materials used by INEC in the elections.

Despite the order, there were allegations of INEC’s hesitancy in granting him and the PDP access to the sensitive materials.

He then filed an ex-parte application to compel INEC to grant access to election materials.

This application was filed on March 10 at the Court of Appeal.

INEC Obeys Court Order

The electoral body has gone ahead to hold a conference meeting between lawyers of the PDP, Labour Party (LP), APC and INEC.

At that meeting, INEC said it “has nothing to hide” and would grant access to the sensitive materials in line with the court order.

Although INEC promised to obey the order, it noted that it might take a while before it could do it.

According to the chairman of the electoral body, some of the materials used were still at the state level.

Therefore, it might take a while before these materials are gathered and the political parties are allowed to inspect them.

Atiku Withdraws Application

According to a statement by Atiku’s spokesperson, Paul Ibe, the former Vice President withdrew the request following INEC’s compliance with the court orders.

He said: Atiku had the applications withdrawn following INEC’s compliance.

“When the matter came up for hearing on Wednesday, the two motions were withdrawn.
