Federal High Court (FHC) sitting in Abuja on Thursday, rejected an application to set aside its judgment recognising the candidates produced by the Dr. Adekunle Rufai Omo-Aje-led leadership of the Action Alliance (AA) party.
Justice Zainab Abubakar ruled that the application filed by the Kenneth Obidiche Udeze-led factional leadership of the party lacked merit.
In a judgment given on November 4, Justice Abubakar ordered the Independent National Electoral Commission (INEC) to accept the candidates submitted for the 2023 general elections by the Omo-Aje leadership of the AA.
The judge also directed INEC to reject those candidates produced by the Udeze among whom is Major Hamzat Al-Mustpha (rtd.).
However, Udeze, had applied to the FHC, Abuja to set aside the November 4 judgment, claiming it was obtained through fraudulent means claiming he was still the party’s national chairman.

The judge stated that her earlier judgment delivered on November 4, was not obtained by fraud as claimed by Mr Udeze.
She described Mr Udeze as a busybody and meddlesome interloper, trying to interfere in the affairs of the party from which he was expelled, proceeding to dismiss the suit.
