The Independent National Electoral Commission (INEC) could be in more legal battles in few days except it meets a demand.

A rights group is demanding that INEC must carry out an investigation or face legal action.

It is not the first time that the Socio-Economic Rights and Accountability Project (SERAP) is issuing a threat.

In the past, the group has threatened legal actions against many others including President Muhammadu Buhari.

However, this time, it is the Independent National Electoral Commission (INEC) that is receiving this threat.

What SERAP Wants

The gubernatorial and State House of Assembly elections were held in 28 states in Nigeria on March 18.

There were reports of violence in several states and this has caused SERAP to make a request.

SERAP is asking INEC to investigate allegations of electoral offenses against governors and their deputies.

Kolawole Oluwadare, SERAP deputy director, says that Section 52 of the Independent Corrupt Practices and Other Related Offences Act allows INEC to appoint an independent counsel to probe the conduct of politicians.

In this light, the SERAP director says the counsel should be set up.

If set up, the counsel will be saddled with investigating allegations of electoral violence and other electoral offenses.

The offenses may include bribery “that may have been committed by any state governors and/or their deputies”.

The Threat

If INEC fails to carry out the investigation, SERAP would initiate legal action against the electoral commission, the director threatens.

SERAP says “identifying, arresting, investigating and prosecuting” the governors would deter others from doing the same in the future.

According to SERAP, INEC has 7 days to respond to their request or they would take the legal route to comply with the request.
