Court Nullifies Candidacy Of Alex Otti, Others In Abia, Kano

The candidature of the Abia State Governor-elect, Dr Alex Otti and all the candidates of the Labour Party (LP), in Abia and Kano States has been nullified.

The nullification was declared by Justice Mohammed Yunusa of the Federal High Court Kano.

The recent development has caused a huge stir on social media, as Nigerians struggle to take their stand on the decision of the court.

To the court, their emergence was not in compliance with the provisions of the 2022 Electoral Act.

Meanwhile, a copy of the judgement delivered by the court was made available to journalists on Friday.

The Invalid Process

The suit No FHC/KN/CS/107/2023 was filed by Mr Ibrahim Haruna Ibrahim.

The petition was filed against the Labour Party and the Independent National Electoral Commission (INEC).

According to the court, the failure of the Labour Party to submit its membership register to the INEC within 30 days before their primaries renders the process invalid.

He ruled that the party has not complied with the provisions of the electoral act.

Hence, the party cannot be said to have a candidate in an election.

Also, the party cannot be declared winner of an election.

Wasted Votes

Therefore, it states that the votes credited to Alex Otti is a wasted vote.

“The party that has not complied with the provisions of the electoral act cannot be said to have candidate in an election.

“Such party cannot be declared winner of an election.

“This being so, the votes credited to the 1st defendant is a wasted vote,”
