He told the court on Tuesday that he had already been tried once by the EFCC, convicted and sentenced in the same charges FHC/ABJ/CR/56/2007, and it would amount to double jeopardy if he was tried again.
He asked this of Justice Inyang Ekwo in an ex-parte motion moved by his counsel, Prof. Awa Kalu (SAN).
Meanwhile, his arraignment which was earlier scheduled for Tuesday, was suspended as the EFCC applied for his trial to be moved from Abuja to the Lagos Division of the FHC.
Prosecution counsel, Chike Okoroma told Justice Ekwo ok Tuesday that the EFCC had written two letters to the Chief Judge seeking for the trial to be moved to Lagos in compliance with a Supreme Court judgement.
Justice Ekwo fixed June 7, 2021 for report of the Chief Judge on the transfer request.
