Lady Gaga has been sued by California-based surf company Lost International for alleged trademark infringement over the Mayhem logos featured on her new merchandise.
The lawsuit, claims that the imagery used to promote the album, , is “substantially similar, if not nearly identical” to a logo the company trademarked in 2015.
Lost International, which has used the Mayhem name since 1986 for surfboards, apparel, and accessories, argues that Lady Gaga’s merchandise could mislead consumers into believing her products are affiliated with the brand.
The company alleges that the pop star’s actions “will damage both Lost and the public” by causing confusion over the source of the goods. “Lost has no control over the quality of goods sold by Lady Gaga, and as a result, has lost control over its valuable goodwill,” the complaint states.
Lady Gaga’s attorney, dismissed the lawsuit as an “opportunistic and meritless abuse of the legal system.”
He added, “Lady Gaga’s Mayhem soared to No. 1 and shattered records, a testament to her unmatched talent and global impact. It’s disappointing but hardly surprising that someone is now attempting to capitalize on her success.”
Lady Gaga’s website has been selling Mayhem-branded clothing and accessories following the album’s release earlier this month. Lost International is seeking damages and an injunction to prevent further use of the disputed logo.
